This petition has been filed with the following main prayer:- "Issue a writ order or direction in the nature of mandamus commanding and directing to the Opposite Party no.2 to 4 to take appropriate strict action against the opposite parties no.5 to 9 for rising illegal construction on the Gata No.172 kha situated in Village Tavkalpur, Tehsil Raniganj, Police Station- Delhupur, District- Pratapgarh, which belongs to the petitioner." From the arguments and pleadings on record, it is evident that the petitioner is aggrieved by the action of the respondent nos.6 to 9 i.e. private respondents in raising illegal construction over the land which is recorded in the name of petitioner as well as the respondent nos.6 to 9. The petitioner has raised disputed questions of fact relating to a private dispute. This petition is disposed of with a liberty to the petitioner to approach the appropriate Forum.
