By the present writ petition, the petitioner who has been posted as Assistant Grade-II in the OfÏce of Tehsildar Basna is questioning the order (Annexure P/1) dated 31.12.2024 on the ground that the petitioner has been transferred from the post of Assistant Grade-II from of OfÏce of Tehsildar Mahasamund to OfÏce of Tehsildar Basna, but in the transfer place of posting i.e. OfÏce of Tehsildar Basna the post of Assistant Grade- II is not available. 2. Learned counsel for the petitioner submits that though the petitioner has joined, but there is no post of Assistant Grade- II is available in ofÏce of Tehsildar Basna. 3. Learned counsel for the State on instruction submits that the petitioner has already joined in the OfÏce of Tehsildar Basna in the post of Assistant Grade- II and even after joining of the present petitioner in the OfÏce of Tehsildar one more Assistant Grade- II is available and there is no illegality in the order passed by the Collector, which is under challenge before this Court. 4. I have heard both the parties and perused the document. 3 5. Looking to the submission made by the State counsel that the petitioner has been posted as Assistant Grade- II in the OfÏce of Tehsildar Basna, the post of Assistant Grade- II is there and the petitioner himself has joined in the present place of posting i.e. OfÏce of Tehsildar Basna in the post of Assistant Grade- II. 6.
