Mahesh Chandra Pant, Advocate / Member Mr. Pradeep Sati, Deputy General Manager for Uttarakhand Transport Corporation is present through video conferencing. 2. Present appeal has been filed for enhancement of the amount awarded by the Tribunal. 3. Learned counsel for the appellants have stated that they want to withdraw the appeal as the amount of Rs. 10,50,000/- awarded by the Tribunal, has already been deposited and the same may be permitted to be withdrawn by the appellants. Both the parties have filed a compromise deed in the form of settlement before the Daily Lok Adalat which runs as under: - “That today the aforesaid A.O. was listed before the Lok Adalat during the course of Lok Adalat, proceeding the 2 compromise was executed between the appellant and Uttarakhand Transport Corporation in the following terms: - (1) The appellant requested to the Uttarakhand Transport Corporation for enhancement upto Rs. 8,00,000/- but the Uttarakhand Transport accepted/agreed for enhancing lump-sum Rs. 6,00,000/- without interest & thereafter the appellant has agreed to accept Rs. 6,00,000/- as enhanced compensation amount. (2) The Uttarakhand Transport Corporation has also agreed to pay the aforesaid amount of Rs. 6,00,000/- to the appellant within one month from the date of receiving the order.” 4. The respondents have agreed to enhance the amount of Rs. 6,00,00/- as lump sum in order to settle the matter. The order of the tribunal shall be modified to the extent of Rs. 16,50,000/- and this amount shall be withdrawn by the claimant in total. At present Rs. 10,50,000/- is only deposited. Rest of Rs.6,00,00/- shall be paid within a period of one month of the receipt of the copy of the order. 5. The effect of the Daily Lok Adalat is that settlements are coming very fast between the parties. The Government of India has introduced the Daily Lok Adalat which is being regularly attended by the counsels and the members present in the Daily Lok Adalat are also supporting the matters of settlement by Daily Lok Adalat. 6. Both the parties are present here. The award is passed accordingly on the following settlements between the parties: - 3 (i) The appeal filed by the claimant shall be treated to be disposed of in terms of the settlement. (ii) The amount of Rs. 10,50,000/- shall be withdrawn by the appellants which has been deposited before the Tribunal. (iii) A statement has been recorded of Mr. Pradeep Sati, Deputy General Manager, for Uttarakhand Transport Corporation to the following effect: He has stated that the claimant may be paid additional sum of Rs. 6,00,000/- and the present appeal is settled for a sum of Rs. 16,00,000/-. In view of the aforesaid statement the enhancement appeal stands allowed and the amount of Rs. 6,00,000/- towards enhancement shall be paid to the claimant within one month from the receipt of the copy of the order. 7.
