4. Present Application has been filed by the Applicant under Section 528 of B.N.S.S. 2023 alongwith compounding application and the same is supported with the affidavits of applicant and respondent nos.2 & 3.

By means of this C528 application, applicant, has sought quashing of the Charge Sheet No.280 of 2021 dated 14.10.2021 for the offences punishable under Section 384, 426, 354, 354-A, 354-C, 354-D of IPC and charges under Section 67 & 67A of IT Act, 2000 registered at Police Station Lalkuan, District Nainital as well as the impugned order dated 26.06.2025 passed by the court of learned Chief Judicial Magistrate, Nainital, District Nainital.
6. Applicant as well as respondent nos.2 & 3 is present in the Court. They are duly identified by their respective counsels.

Learned counsel for the parties have filed their respective affidavits along with the compounding application stating therein that they do not wish to pursue the present criminal case any further and a compromise has been entered between them.
8. Learned State counsel has opposed the compounding application.

After interacting with the parties especially respondent no.3-Laxmi @ Laxmi Ray, who submits that she has moved on; got married; has a family and a child thus entangling in such case would reflect her past life, which would be hindrance on the part that she has taken now. Respondent no.2-Ratan Rai also wishes to withdraw the said criminal case.
10. Heard learned counsel for the parties and perused the material available on record.

In view of the principle of law laid down by Ho’ble the Apex Court in the case of Gian Singh vs. State of Punjab reported in 2012 (10) SCC 303, criminal proceedings can be quashed by this Court, if this Court is satisfied that matter has been settled between the parties amicably and parties are interest to restore peace and harmony between them.
12. Having heard learned counsel for the parties and in view of the above, the compounding application is allowed. The impugned order dated 26.06.2025 passed by the court of learned Chief Judicial Magistrate, Nainital, District Nainital as well as the Charge Sheet No.280 of 2021 dated 14.10.2021 for the offences punishable under Section 384, 426, 354, 354-A, 354-C, 354-D of IPC and charges under Section 67 & 67A of IT Act, 2000 registered at Police Station Lalkuan, District Nainital are hereby quashed.
13. Accordingly instant C528 application stands disposed of.
