Sri Vinod Kumar Singh has put in appearance on behalf of the opposite party no.5. His Vakalatnama is taken on record. 2. The present petition has been filed with the following prayer : "To issue a writ, order or direction in the nature of Mandamus commanding the opposite parties to remove the encroachment on the land plot no.1606, area about 0.0450 hectare, situated in village Majnawan, Tehsil Sohawal, District Ayodhya and further be please to direct them for construction of Chak Marg on the said land in the interest of justice, the Uddharan Khatauni of which for Fasli Year 1425-1430 is annexed with this writ petition as Annexure No: 1." 3. Standing Counsel has filed the counter affidavit, which is taken on record, which indicates that the proceedings under section 67 of the U.P. Revenue Code have already been initiated. 4. Considering the same, present petition is disposed off with direction to conclude the proceedings under section 67 of the U.P. Revenue Code. 5. It is clarified that the respondent no.5 would be at liberty to take all the pleadings available to him while defending the proceedings under section 67. The proceedings shall be concluded after exchange of evidence and after giving opportunity of cross examination.
