Neutral Citation No. - 2025:AHC-LKO:46715 Court No. - 6 Case :- WRIT - C No. - 1005605 of 2010 Petitioner :- C/M Ram Pratap Junior High School Gram Pratapganj Sultanpur Respondent :- Deputy Registrar Firms Societies And Chits Faizabad And Anr. Counsel for Petitioner :- S.K. Mehrotra,Dileep Kumar Mishra,I.D. Shukla,Indra Pratap Singh,R.U. Pandey,Ramesh Pandey Counsel for Respondent :- M.B. Singh,Rajiv Kumar Bajpai,Ram Dheeraj Yadav,Suparna Mishra Hon'ble Pankaj Bhatia,J. 1. Heard learned counsels for the parties. 2. The present petition has been filed by the petitioners seeking a writ of certiorari quashing the order dated 09.07.2010 i.e. Annexure No.1, whereby the list of members submitted by the President of the Society was accepted, in the said order, it was stated that the president of the society, namely, Shri Ganesh Prasad Pandey was continuing as a President since 1992 and had submitted the list of 52 members over inducted as members of the society. Along with the said list, the receipt with regard to their payments, cash book, etc. were also produced, which holds the signatures of the petitioner, who was then the Manager of the Society. Based upon the said, the authority noticed that the petitioner no.2 here had filed objections stating that the signatures on the cash book sheet, etc. were forged. He argues that he had never made the signatures which were depicted to be made by him. The authority concerned, etc. submitted mainly on the ground that the accounts were furnished including an expenditure statement, which indicated that the list of the members submitted was valid. It was also noticed that the list of members submitted by the petitioner no.2 included 23 members, who were also part of the 52 members' list submitted by the then president. 3. The contention of learned counsel for the petitioners is that, the factually incorrect statement has been recorded that the list of 23 members submitted by the petitioner were also included in the list of 52 members submitted by the then president. 4. He further argues that no consideration was accorded to the statement that the signatures of the petitioner no.2, on the receipts were forged, it is fairly admitted that by counsel for petitioner no.2 that he is no more manager of the society. 5. Considering the fact that the issue with regard to the signatures, being forged or otherwise, cannot be gone into exercise of jurisdiction under Article 226 of the Constitution of India, no interference is called for. 6. The petition is, accordingly, dismissed. Order Date :- 8.8.2025 Praveen Digitally signed by :- PRAVEEN KUMAR High Court of Judicature at Allahabad, Lucknow Bench
