3. Mr. Imran Ali Khan, learned counsel holding brief of Mr. Harsh Vardhan Dhanik, learned counsel for respondent nos.2 & 3.
4. The present criminal misc. application under Section 528 of B.N.S.S. was filed on behalf of the Applicant, Satnam Singh S/o Bhupendra Singh against the Respondents, Smt. Kuljeet Kaur W/o Satnam Singh and Jageer Singh S/o Bilaka Singh, who is the complainant; the present application comes with the prayer that the impugned summoning/cognizance
order dated 12.02.2025 passed by the learned Chief Judicial Magistrate, Udham Singh Nagar, charge-sheet filed against the present Applicant as well as the entire proceedings of Criminal Case No.349 of 2025 (FIR No.96 of 2024) titled as
“State vs. Satnam Singh” for the offence punishable under Sections 498-A, 323 & 506 of IPC and under Section 3/4 of Dowry Prohibition Act, P.S. Pantnagar, District Udham Singh Nagar be quashed. 5. The Compounding Application (IA No.02 of 2025) is also annexed with the present application that is supported with the affidavits of the parties and the said application is being endorsed by the learned counsel for the Applicant and Respondent nos.2 & 3, Mr. Kovid Bhatt, Advocate and Mr. 2025:UHC:10732 Imran Ali Khan, learned counsel holding brief of Mr. Harsh Vardhan Dhanik, Advocate respectively. 6. The parties are present before this Court, who are identified by their respective counsel. 7. After interacting with the parties especially with Respondent no.2, Smt. Kuljeet Kaur, she makes a statement that due to intervention of well-wishers and family members of both the parties, Respondent no.2 and Applicant have settled the dispute amicably outside the Court with mutual consent that they will part their ways separately; the Respondent no.2 and the Applicant will proceed through mutual divorce petition, which is pending before the learned Family Court, Rudrapur, District Udham Singh Nagar and now the Respondent nos. 2 & 3 do not want to prosecute the Applicant; Since the parties have already entered into a compromise so arrived at between the parties, hence, the charge-sheet, the impugned cognizance order as well as the entire proceedings may be quashed, whereas learned State counsel poses his formal objection in this regard. 8. In view of the principle of law laid down by Hon'ble the Apex Court in the case of “Gian Singh vs. State of Punjab” reported in 2012 (10) SCC 303 as well as in Transfer Petition (Criminal) No. 115 of 2012 (Dimpey Gujral vs. Union Territory of Chandigarh) decided on 06.12.2012, criminal proceedings can be quashed by this Court, if this Court is satisfied with the facts and circumstances of the case. 9. Keeping in view of the totality of the facts and circumstances of the case, this Court is of the view that ends of justice would be met, if the entire proceedings against qua the Applicant are hereby quashed. 10.
In view of the above, the compounding application is

The impugned summoning/cognizance order dated 12.02.2025 passed by the learned Chief Judicial Magistrate, Udham Singh Nagar, charge-sheet filed against the present Applicant as well as the entire proceedings of Criminal Case No.349 of 2025 (FIR No.96 of 2024) titled as “State vs. Satnam Singh” for the offence punishable under Sections 498- A, 323 & 506 of IPC and under Section 3/4 of Dowry Prohibition Act, P.S. Pantnagar, District Udham Singh Nagar against the Applicant, are hereby quashed. 11. The present Criminal Misc. Application under Section 528 of B.N.S.S. is, thus, disposed of in terms of the compromise arrived at between the parties. 12. Pending applications, if any, stand disposed of accordingly.
