THE HONOURABLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO:9011/2025 ORDER:
The present writ petition is filed under Article 226 of the Constitution of India seeking following relief:
“to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not passing any orders on the application and representation submitted by the petitioners dated 04.01.2025 for grant of pattadar books and title deeds in their favour as arbitrary, illegal, improper, irregular, unreasonable, unwarranted, unjustified and unconstitutional and consequently direct the respondents herein to pass orders on the application and representation made by the petitioners on 04.01.2025 for grant of pattadar pass books and title deeds for the lands assigned to them by way of pattas and pass such other order or orders ….”
2. Heard learned counsel for the petitioners and learned Government Pleader for Revenue for the respondents. 3. The case of the petitioners herein is that the petitioners were assigned the subject lands in their favour by way of pattas and their possession was confirmed by way of enjoyment certificates issued by respondent No.4 herein. After granting of assignment pattas as well as enjoyment certificates in their favor, all the petitioners herein submitted a common representation dated 04.01.2025 seeking for issuance of pattadar pass book and title deed in their favour in respect of their respective property. Even after receipt of the said
representation, the respondents neither considered the same nor issued any proceedings. Hence, the writ petition. 4.
On the other hand, learned Government Pleader for the respondents categorically submits that once the petitioners sought for issuance of pattadar pass books and title deeds in respect of their respective property and also mutation of their names in the revenue records pursuant to the lands assigned to them through alleged assignment pattas and enjoyment certificates issued in their favour, each applicant/ petitioner herein shall make an appropriate application in Form-6A through Mee-seva/ AP Online/ Village Secretariats by paying requisite fee in accordance with Rule 18(2) of the Andhra Pradesh Rights in Land and Pattadar Pass Books Rules, 1989. He further submits that with single representation the grievance of all the petitioners herein cannot be addressed and contrary to procedure mandated under Rule 18(2) of the Rules, 1989. 5. In reply to the said submissions made by the learned Government Pleader for the respondents, learned counsel for the petitioners expressed their inability, since they do not possess original pattas which were issued in their favour, they were unable to access online application in Form No.6-A. As such, the petitioners herein submitted common manual representation ventilating their grievance. 6. Having regard to the submissions made by the learned counsel for the petitioners and learned Government Pleader for the respondents, on perusal
of the material placed on record, this Court is of the considered view that the present writ petition can be disposed of, directing respondent No.4 herein to consider the common representation submitted by the petitioners herein and suggest alternative mode of compliance instead of Form No.6-A and pass appropriate orders, in accordance with law, within a period of two (02) months from the date of receipt of a copy of this order. 7. With the above direction, the writ petition is disposed of. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in the writ petition shall stand closed. ________________________________ VENKATESWARLU NIMMAGADDA, J 07.04.2025 BSP
