Present Application has been filed for grant of regular bail in connection with the Case Crime No.346 of 2024, registered at police station Doiwala, District Dehradun. 2. The applicant-Nirmal Singh is in judicial custody for the offence under Section 8/20 of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3. As per the First Information Report, the police party apprehended the applicant on 27.11.2024 and recovered 4 kg. 5 grams of ganja from the possession of the present applicant. 4. Heard Mr. Bhuwan Bhatt, learned counsel for applicant and Mr. Akshay Latwal, learned Brief Holder for respondent. 5. Mr. Bhuwan Bhatt, Advocate, has contended that the applicant is an innocent person. He has been 1 2025:UHC:629 falsely implicated in the present matter. Nothing was recovered from his possession. The alleged recovered contraband is much below the commercial quantity. Applicant does not have any criminal antecedents. He is a permanent resident of District Bijnor, Uttar Pradesh, therefore, there is no likelihood of his absconding. 6. Mr. Akshay Latwal, learned Brief Holder, has opposed the Bail Application orally. 7. Having considered the submissions of learned counsel for both the parties and in the facts and circumstances of the case, without expressing any opinion as to the merit of the case, this Court is of the view that the applicant deserves bail at this stage. 8. The Bail Application is allowed. 9.
