Order on C.M. Application No. 1 of 2025
1. This intra court appeal arising out of the judgement and
order dated 18.4.2025 is delayed by 8 days.
2. An application for condonation of delay supported with an affidavit has been filed by the appellant along-with the appeal.
3. Reasons in detail have been spelt out in the affidavit filed in support of delay condonation application to which there is no objection.
4. In absence of any objection and the cause shown being sufficient, the delay in filing the present intra court appeal is condoned and the application allowed.
Order on Appeal
5. Heard learned counsel for the appellant and learned Standing Counsel for the State.
6. The intra court appeal filed under Chapter VIII Rule 5 of the Allahabad High Court Rules is directed against the
judgment/order passed by the writ court on 18.4.2025 in Writ A No. 3934 of 2025 whereby the writ petition
directed against the order of suspension coupled with the disciplinary proceeding was disposed of with the direction to the disciplinary authority to conclude the disciplinary proceedings within a stipulated period of time.
7. On a perusal of paragraph 4 of the impugned judgment, we gather that it was on the statement of the appellant-
petitioner himself that he had prayed for a writ of mandamus directing the disciplinary authority to conclude the disciplinary proceedings expeditiously once the charge- sheet has come to be issued against him.
8. The writ court in view of the statement made by the appellant has proceeded to dispose of the writ petition with the direction as aforesaid. The order impugned is virtually a consensus order passed by the writ court and the appeal against the same would not lie.
9. That being the position, we decline to entertain the present appeal and the same is accordingly dismissed. . [Jaspreet Singh,J.] [Attau Rahman Masoodi, J.]
