Heard Ms. Nisha Verma, learned counsel appearing for the petitioner. 2. In view of the order proposed, notice to Respondent No. 2 is hereby dispensed with. 3. The instant petition has been filed under Article 227 of the Constitution of India inter alia praying therein for the following reliefs: "1- समममनननय नयमयमलय आददश ननदरश कद दमरम नवपकन सस० 1 ससनवल जज अवर खणड ममसमनफरखमनम समलतमनपमर कद नयमयमलय मम नवचमरमधनन समधमरण वमद सस० 138/2024 नशवकम ममरन बनमम रमजकम ममरन पमररनम पत आददश 39 ननयम 1 व 2 सन०पन०सन० सरमयन ननषदधमजम पमररनम पत नदननक 12.04.2024 कम ननसतमरण शनघ अनत शनघ करनद कम आददश ददनद कक महतन कक पम करम। 2- समममनननय नयमयमलय यमनचकम कद नवचमरणकमल मद सव० रमम नकशमन पमत छददन ननवमसन गमम बडम गनव ममजम हहससनगसज कलम परगनम जगदनशपमर तहसनल ममसमनफरखमनम सजलम अमदठन मम ससरत गमटम ससखयम 145 रकबम 0.4360 हद०, गमटम ससखयम 644 रकबम 0.4890 हद०, गमटम ससखयम 1234 रकबम 0.0510 हद०, गमटम ससखयम 1233 रकबम 0.4720 हद0, गमटम ससखयम 1237 रकबम 1.3990 हद०, कक कक नष भभनम कक यरमससरनत बनमयद रखनद कम आददश ददनद कक महतन कक पम करद। 3- समममनननय नयमयमलय कक दनष मद अनय ककई नयमयकनचत आददश ननदरश उपषम व अनमतकष यमचन कद पक मम हक पमररत व पदमन करनद महतन कक पम करद।" 4. Learned counsel appearing for the petitioner has submitted that the petitioner had filed a civil suit i.e. Regular Suit No. 138 of 2024 (Shivkumari vs Rajkumari) in the court of the learned Civil Judge (Junior Division) Musafirkhana, Sultanpur in the year 2024 along with an application under Order XXXIX Rule 1 and 2 of the Code of Civil Procedure seeking interim injunction. It has further been submitted that the aforesaid application for interim injunction is pending before the trial court since the year 2024. 5. Learned counsel appearing for the petitioner has argued that there is urgency in the matter therefore, it is in the interest of justice that the application filed under Order XXXIX Rule 1 and 2 of the Code of Civil Procedure be decided at the earliest. 6. I have considered the arguments advanced by the learned counsel appearing for the petitioner and I find that the application filed by the petitioner, under Order XXXIX Rule 1 and 2 of the Code of Civil Procedure in Regular Suit No. 138 of 2024 (Shivkumari vs Rajkumari), is pending since the year 2024. 7. In view of the aforesaid reasons, this petition is disposed of with a direction to the learned Civil Judge (Junior Division) Musafirkhana, Sultanpur to hear and decide the application filed under under Order XXXIX Rule 1 and 2 of the Code of Civil Procedure filed in Regular Suit No. 138 of 2024 (Shivkumari vs Rajkumari) expeditiously, preferably within a period of six months from the date of presentation of certified copy of this order.
