By way of instant petition, a prayer has been made for transfer of Case No. 401 of 2024, titled as Jaswinder vs. Fulwanti alias Meenu from the Court of Addl. Principal Judge, Family Court, camp at Arki, District Solan, H.P. to the Court of Principal Judge, Family Court, Shimla. 2. The petitioner/wife has projected the reasons of her adverse conditions for transfer of case from Arki to Shimla. It is averred that the petitioner/wife does not have sufficient resources to contest the litigation out stationed. She is presently residing with her parents at Shimla. 1 Whether reporters of the local papers may be allowed to see the judgment? 2 ( 2025:HHC:21338 ) 3. It has also been submitted that the respondent is also working at Shimla and no prejudice will be caused to him in case the matter is transferred to Shimla. The averment with respect to the respondent working at Shimla has not specifically been denied. It has also been mentioned that the respondent works as a Taxi Operator. 4. Keeping in view the entirety of facts and circumstances of the case, more particularly, the fact that the distance between Arki and Shimla is about 34 kilometers only, it will not otherwise also be inconvenient to the respondent to contest the proceedings at Shimla. 5. Accordingly, the instant petition is allowed and the Case No. 401 of 2024, titled as Jaswinder vs. Fulwanti alias Meenu is ordered to be transferred from the Court of Addl. Principal Judge, Family Court, camp at Arki, District Solan, H.P. to the Court of Principal Judge, Family Court, Shimla. (Satyen Vaidya) Judge 4th July, 2025. (jai)
