Irrigation And Water Resources Deptt. U.P. And 2 Others Counsel for Petitioner :- Amit Kumar,Sakshi Singh,Sameer Singh Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Manish Kumar,J.
1. The agreement/contract was entered into between the opposite parties on 05.07.2014 for installing 40 unipoles. However, notice was given to the petitioner on 14.08.2024 pointing out certain deficiencies, to which he responded on
04.09.2024. However, the response was not found satisfactory and the Chief Engineer issued a direction on 04.12.2024, in pursuance to which, the Executive Engineer cancelled the agreement vide order dated 21.01.2025. Further intimation in this regard has been sent to the petitioner on 08.05.2025. It is this cancellation of the contract or the agreement which is under challenge.
2. We are of the opinion that considering the issues involved, it is not a matter to be considered or adjudicated under Article 226 of the Constitution of India, especially looking into the allegations in the notice dated 14.08.2024, a copy of which has been annexed as Annexure No. 6, as disputed questions of fact are involved and a roving inquiry cannot be conducted by this court under Article 226 of the Constitution of India, as such the petitioner may avail other remedies.
3. Accordingly, the present writ petition is disposed of.
4. It shall be open for the petitioner to move a representation before the concerned authorities, which can be considered if otherwise permissible under the law. (Manish Kumar, J.) (Rajan Roy, J.)
