And Others Counsel for Petitioner :- Chandra Shekhar Shukla Counsel for Respondent :- C.S.C.,Pankaj Gupta Hon'ble Rajan Roy,J. Hon'ble Praveen Kumar Giri,J. 1. Heard. 2. There appears to be some dispute with regard to the Sahen which the petitioner claims to be his, while others claim their rights in respect thereof. It is a purely private dispute between the parties which is not amenable to adjudication under Article 226 of the Constitution of India. 3. We are not concerned with the private dispute. We are only concerned with the interference of the police. Obviously if the private parties are creating law and order problem the police will interfere, however, in this case we observe/ direct that the police shall come into the picture only if there is an apprehension of breach of peace or apprehension of commission of any crime or it is actually committed or there are other valid grounds in any law/ statue for their interference, but, without interfering in the civil dispute between the parties. 4. The writ petition is, accordingly, disposed of. . (Praveen Kumar Giri, J.) (Rajan Roy, J.)
