Learned counsel for the petitioner submits that the said order was passed without giving opportunity of hearing to the petitioner and not even a show cause notice was served upon the petitioner. 6. Learned State Counsel, however, submits that petitioner has statutory remedy of appeal as per provisions of Uttarakhand Urban and Country Planning and Development Act, 1973. 7. This position is not disputed by learned counsel for the petitioner. 8. Accordingly, the writ petition is disposed of with liberty to petitioner to approach the Appellate Authority within ten days from today. If petitioner files appeal within stipulated time, then the same shall be heard and decided on merit. For a period of ten days, no coercive action shall be taken against the petitioner, pursuant to the impugned order.
