1 2025:CGHC:13537 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR WPS No. 1929 of 2025 1. Loknath Nag S/o Shri Faganu Ram Nag Aged About 61 Years Lecturer, Presently Posted As In-Charge Block Education Officer, Bastar, Block Bastar, District Bastar At Jagdalpur, C.G. ... Petitioner versus 1. State Of Chhattisgarh Through The Secretary, School Education Department, Mahanadi Bhawan, Atal Nagar, Nawa Raipur, District- Raipur (C.G.) 2. The Collector Bastar, District- Bastar At Jagdalpur (C.G.) 3. District Education Officer Bastar, Distt.- Bastar At Jagdalpur (C.G.) 4. Shri Chandrashekhar Yadav Lecturer, Working At Govt. Higher Secondary School, Dhanpuji, Block- Jagdalpur, Distt.-Bastar At Jagdalpur (C.G.) ... Respondents Cause title is taken from the Case Information System For Petitioner : Shri Somkant Verma, Advocate For Respondent/State : Shri Vivek Sharma, Addl. Adv. General Order on Board By Bibhu Datta Guru, J. 21/3/2025 1. By the present petition, the petitioner is seeking quashment of the order dated 5-3-2025 (Annexure-P/1) passed by the respondent No.2. 2. Learned counsel appearing for the petitioner would submit that the petitioner is a senior most Lecturer and looking to his work and experience the charge of Block Education Officer, Block Bastar has been given to him, 2 however, all of a sudden that too without there being any administrative exigency by the order impugned the petitioner has been sent to his original place of posting i.e. Government Higher Secondary School, Badechakwa, Block Bastar and in his place the charge of Block Education Officer has been given to the respondent No.4, who is a junior to the petitioner. The said order is illegal, arbitrary and not at all sustainable in the eyes of law. 3. On the other hand, learned counsel appearing for the State would support the impugned order, which has been passed owing to administrative exigency. 4. I have heard learned counsel appearing for the parties and perused the pleadings and documents. 5. It is not in dispute that the original post of the petitioner is Lecturer and considering the requirement, at the relevant point of time, the charge of Block Education Officer, Block Bastar, given to the petitioner and now by the order impugned he has been sent to his original place of posting i.e. Government Higher Secondary School, Badechakwa, Block Bastar and in his place the charge of Block Education Officer given to the respondent No.4. It is not the question herein that by keeping the petitioner in the same office, the charge of Block Education Officer is given to his junior i.e. respondent No.4. Thus, the petitioner is not entitled to get the benefit as per the circular dated 14/7/2024 issued by the Department of General Administration, Government of Chhattisgarh. The charge of a particular post is not permanent and the same may be changed looking to the administrative exigency. The petitioner failed to prove his case by placing sufficient and cogent material. 6. In the result, the writ petition, being devoid of merit, is liable to be and is hereby dismissed at the motion stage itself.
