Neutral Citation No. - 2025:AHC:37438-DB Court No. - 29 Case :- WRIT - C No. - 3024 of 2025 Petitioner :- Ram Singh Respondent :- State Of U.P. And 4 Other Counsel for Petitioner :- Dwijendra Prasad Counsel for Respondent :- C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Ms. Nand Prabha Shukla,J. Heard learned counsel for the petitioner and learned Standing Counsel for the State-authorities. Petitioner claims to be a seventy year old person who is aggrieved by the action of one of his sons who apparently is ill-treating him and a representation in that regard is annexed. We have perused the representation which is absolutely silent with regard to the date and time of such alleged act of offence against the petitioner. Even otherwise we are of the view that in the event, petitioner has been ill-treated or is physically tortured, the remedy of the petitioner would be to lodge a police report or to approach the Magistrate, if there is failure on the part of the authority to register the FIR. Filing of writ petition for the purpose before this Court, is not appropriate remedy, at the first instance. Leaving it open for the petitioner to pursue appropriate remedy before the competent forum, this writ petition is consigned to records.
