JUSTICE MITALI THAKURIA ORDER 18.06.2025 Heard Mr. A. K. Azad, learned counsel for the petitioner. Also heard Mr. B. Sharma, learned Additional Public Prosecutor for the State respondent No.1. This is an application filed under Section 528 of BNSS, read with Article 227 of the Constitution of India in connection with Baghbar P. S. Case No. 24/2025, registered under Sections 281/125(b) of BNS. It is submitted by Mr. Azad, learned counsel for the petitioner, that the vehicle was seized in connection with Baghbar P.S. Case No. 24/2025, under Sections 281/125(b) of the BNS. However, he could not obtain a certified copy of the seizure list, as no such list has been prepared by the Investigating Officer, and the vehicle is not shown to have been seized by the police in connection with this case. He further submitted that he had also approached the learned Trial Court with a similar petition seeking zimma of the vehicle, but the petition was not entertained, as he could not furnish the seizure list along with the zimma petition. Considering the submission made by the learned counsel for the petitioner, the petitioner is hereby directed to approach the learned Trial Court with an appropriate application, praying for intimation regarding the status of the case as well as the current status of the vehicle, specifically, whether it has been seized in connection with this case or not. Further, the present petition cannot be entertained by this Court at this stage. Page No.# 3/3 With the above observations and directions, this petition stands disposed of. JUDGE Comparing Assistant
