Both the learned counsel for the parties submit that the issue projected in the instant petition is covered by the judgment dated 26.09.2025 passed by this Court in the writ petition WP(C) No. 2472/2022 titled – “M/s Saint Soldier Engineer and Contractor Pvt. Ltd. Vs UT of J&K & Ors.”. Accordingly, Sh. M. K. Bhardwaj, learned Senior Advocate for the Serial No. 11 2 WP(C) No. 2470/2022 CM No. 6776/2022 petitioner, prays that the instant petition be disposed of on the analogy of the aforesaid judgment, to which, Mr. Ravinder Gupta, learned AAG appearing on behalf of the respondents, is not averse. 02. With the consent of the learned counsel for the parties, the instant petition is taken up for final disposal at this stage by directing the respondents to take a decision, in the light of the admitted liabilities in the instant matter, regarding the release of payment to the tune of Rs. 10,35,000/- in favour of the petitioner, along with interest, on the same lines as held by this Court in the judgment (supra). The said exercise shall be completed, and payment to be released, within a period of six weeks from today. 03. It is further made clear that while taking a decision in the instant matter, the respondents shall give due consideration to the communication dated 16.07.2022 addressed by the concerned Executive Engineer, PWD (R&B) Construction Division No. I, Jammu to the Chief Engineer, PW (R&B) Department, Jammu, wherein the Executive Engineer has certified that the allotted work has been duly executed by the petitioner and that his pending payment to the tune of Rs. 10,35,000/- has not been released. Accordingly, a request has been made therein for release 3 WP(C) No. 2470/2022 CM No. 6776/2022 of funds under the relevant head with a view to enable payment to the petitioner. 04. The instant petition is, accordingly, disposed of in the manner indicated above, along with connected application(s).
