JUSTICE PARTHIVJYOTI SAIKIA ORDER Date : 25.06.2025 Since these applications arise out of the same FIR, the applications are taken up together for disposal by this common order. 2. Heard Mr. G Chamuah, Mr. A. Ali as well as Mr. D Gogoi, the learned counsel appearing for the petitioners. Also heard Mr.Bhaskar Sarma, the earned Additional Public Prosecutor for the State of Assam. 3. These applications are filed under Sections 483 & 482 of the BNSS, 2023
Page No.# 3/3 whereby the petitioners Sayed Tanfiz Ahmed has prayed for releasing him on bail after he was arrested in connection with Silapathar P.S. Case No. 123/2025, whereas the petitioner Nipom Das and Bitu Dihingia have prayed for grant of pre-arrest bail in connection with the said case. 4. On 1st June, 2025, at about 12.30 midnight, the informant had stopped for having tea in a shop. At that time some persons attacked him with sharp weapon and also showed pistols. The informant was beaten up. His friends were also beaten up. The informant was compelled to transfer ₹60,000/- through Google Pay to the account of one of the accused persons. 5. The case diary reveals that the present petitioners are involved in the aforementioned case. As per the case diary, the petitioner Bitu Dihingia is the mastermind of the entire episode. 6. Mr.
Bhaskar Sarma submits that the case is in a preliminary stage of investigation and therefore, the bail applications of the petitioners need not be considered at this stage. 7. I have considered the submissions made in the light of materials available in the case diary. 8. There are incriminating materials in the case diary against the petitioners. 9. Therefore, this Court is of the opinion that by allowing the bail applications of the petitioners at this stage would hamper the investigation of the case. With the aforesaid direction, all the three applications are dismissed and disposed of accordingly. The CD shall be returned. JUDGE Comparing Assistant
