JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioner is seeking to enlarge her on anticipatory bail in a case registered in Crime No.664/2024 of Sampigehalli Police Station, Bengaluru, for offences punishable under Sections 316(2), 318(4), 351 read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023. 2. Heard both sides and perused the material on record. 3. The aforementioned crime is registered against accused Nos.1 and 2 on a complaint lodged by one Sri.Manjunath.G, S/o. G. Veeranna. Petitioner is arrayed as accused No.2 in the FIR. 4. The complainant has averred that he is doing interior wood work business. Accused No.1 - Bhaskar Reddy residing close to his factory befriended him saying that he is doing scrap and real estate business. In the year 2023, he convinced the complainant saying that they can do scrap business by joint partnership and he would get huge profit out of the said business. Believing his words, the complainant - 3 - NC: 2025:KHC:5879 CRL.P No. 952 of 2025 initially gave a sum of Rs.1,00,000/- for which he was given profit of Rs.20,000/- every month. Thereafter, accused No.1 informed him that if he invests Rs.3 to 4 lakhs, then he will get double the said amount. It is alleged that believing the words of accused No.1, complainant transferred a sum of Rs.24,46,000/- in instalments through online to the accounts of accused No.1 – Bhaskar Reddy and accused No.2 – Shymala. Again, on 22.09.2024 accused No.1 got transferred another sum of Rs.20,000/- through PhonePe. Thereafter, showing some documents pertaining to vacant sites and telling that those sites are for sale, induced the complainant to invest another sum of Rs.27,00,000/- lakhs and cheated him to the tune of Rs.51,46,000/-. 5. It is further alleged in the complaint that, similarly accused No.1 – Bhaskar Reddy cheated one Mohammed Sadiq to the tune of Rs.23,54,500/-, Ravi.C to the tune of Rs.8,20,000/-, Nagesh.C to the tune of Rs.8,84,000/- and one Ameerulla Khan, a sum of Rs.6,00,000/-. 6. Petitioner arrayed as accused No.2 in the FIR is said to be the wife of accused No.1. It is alleged that the amount was transferred to the accounts of accused No.1 as well as - 4 - NC: 2025:KHC:5879 CRL.P No. 952 of 2025 accused No.2. However, it is nowhere mentioned in the complaint that accused No.2 had either met the complainant or she told him to invest money in the scrap business. The entire allegations are against accused No.1. Unless it is shown that the petitioner has colluded with accused No.1, which material is lacking at this stage, relief sought in the petition cannot be denied. Petitioner is a woman. Petitioner has undertaken to co-operate with the investigation of the case. Hence by imposing conditions, petitioner can be granted the relief. Accordingly, the following order: ORDER i) Petition is allowed. ii) Petitioner / accused No.2 in Crime No.664/2024 registered by Sampigehalli Police Station, Bengaluru, shall be released on bail subject to following conditions: a) She shall appear before the Investigation Officer within a period of ten days from the date of receipt of a copy of this order. b) She shall execute a personal bond in a sum of Rs.1,00,000/- (Rupees One Lakh Only) with a surety for the likesum. - 5 - NC: 2025:KHC:5879 CRL.P No. 952 of 2025 c) She shall co-operate with the investigation. d) She shall furnish proof of her residential address and shall inform the Investigation Officer/Court, if there is change in the address. e) She shall not tamper with the prosecution witnesses either directly or indirectly. f) She shall appear before the trial Court on all dates of hearing without fail, unless exempted from appearance for genuine reasons.
