Hon'ble Rajnish Kumar,J. Heard. This Court had passed the following order on 02.04.2025:- "As per office report, the sole appellant has died. As per report dated 09.08.2024 in regard to the living status of Jagdev son of Badri Prasad Dubey of the Chief Judicial Magistrate, Gonda after recording statements indicates that the sole appellant Jagdev son of Badri Prasad Dubey has died on 05.07.2020. However in the last but one line of first paragraph of the report dated 09.08.2024, the appellant name has been mentioned as Vasdev son of Badri Prasad Dubey, whereas as per the second line of the said paragraph, the report has been submitted in regard to Jagdev son of Badri Prasad Dubey. In view of above, let a clear report be called from the C.J.M. Gonda before the next date. List on 22.04.2025." In deference to the aforesaid order, the Chief Judicial Magistrate, Gonda has sent a report dated 16.04.2025 disclosing therein that due to typographical error Vasdev was typed wrongly in place of Jagdev and Jagdev son of Badri Prasad Dubey has died on 05.07.2020.
