Neutral Citation No. - 2025:AHC:24512-DB Court No. - 42 Case :- CRIMINAL MISC. WRIT PETITION No. - 1982 of 2025 Petitioner :- Tahir Saifi @ Tahir Husain Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Amit Kumar Pandey Counsel for Respondent :- G.A. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J.
1. Heard learned counsel for the petitioner and learned A.G.A. for the State respondents.
2. The relief sought in this petition is for quashing of the F.I.R. dated 12.11.2024 registered as Case Crime No.526 of 2024 under Section 76, 123 BNS, Section 3(2) (v) SC/ST Act and Section 67 IT Act, Police Station Dhampur, District Bijnor. Further prayer has been made not to arrest the petitioner in the aforesaid case.
3. Learned A.G.A. submits that notice under the SC/ST Act has been served upon the informant on 30.01.2025. He raised a preliminary objection regarding maintainability of the writ petition on the ground that the present writ petition has been preferred with concealment of material fact. He submits that the petitioner is having criminal history of three cases, which is not divulged in the writ petition and only to get some reprieve in the present proceeding, the criminal antecedents had deliberately been suppressed, therefore, the present writ petition is liable to be dismissed with exemplary cost.
4. Confronted with this situation, learned counsel for the petitioner states that the petitioner does not want to press the writ petition and the same may be dismissed as not pressed with leave to invoke the remedy as available in law.
5. Accordingly, the writ petition is dismissed as not pressed. Needless to say, in case the petitioner is aggrieved, it is open to the petitioner to press the remedy as available in law.
