Neutral Citation No. - 2025:AHC-LKO:34114 Court No. - 15 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 4971 of 2025 Applicant :- Mohd. Akram Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Lko. Counsel for Applicant :- Rakesh Kumar Yadav Counsel for Opposite Party :- G.A.,Yogesh Kumar Mishra Hon'ble Subhash Vidyarthi,J.
1. Heard Sri Rakesh Kumar Yadav, the learned counsel for the applicant, Sri Anant Pratap Singh, the learned A.G.A. for the State, Sri Yogesh Kumar Mishra, the learned counsel for the complainant and perused the records. 2. The instant application has been filed seeking release of the applicant on bail in Case Crime No. 303 of 2025, under Sections 69, 352 of the B.N.S., 2023, Police Station Kotwali Nagar, District Sultanpur. 3. The aforesaid case has been registered on the basis of an F.I.R. lodged on 16.04.2025 stating that the applicant runs a shop opposite the informant's house, he used to give financial aid to the informant as her husband is unemployed and the applicant had physically exploited her for the past three years. When she objected, the applicant used to allure her that he would marry her. 4. In the affidavit filed in support of the bail application, it has been stated that the applicant is innocent, he has been falsely implicated in the present case and he has no criminal history. 5. It has further been stated that earlier the applicant had lodged an FIR bearing Case Crime No. 0270 of 2025, under Sections 115(2), 352, 352(2) B.N.S. against the informant's husband and,
thereafter, the present FIR has been lodged on false allegations as a counter blast. 6. Learned A.G.A. has opposed the bail application and he has submitted that the allegations have been established during investigation and a charge-sheet has been submitted on
18.05.2025. 7. Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that as per FIR the informant is a married woman and, therefore, the allegation that the applicant had allured to marry her appears to be false on the face of it, coupled with the fact that the applicant is languishing in jail since 17.04.2025 whereas the investigation already stands concluded, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail in the aforesaid crime. 8.
8. Accordingly, this bail application stands allowed. 9. Let the applicant-Mohd. Akram be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:- (i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses; (iii) the applicant shall appear on each and every date fixed by the trial Court.
