Neutral Citation No. - 2025:AHC:135958 Court No. - 52 Case :- WRIT - A No. - 3847 of 2019 Petitioner :- Pradyumn Lal And 2 Others Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Ved Byas Mishra Counsel for Respondent :- Ashok Kumar Yadav,C.S.C. Hon'ble Mrs. Manju Rani Chauhan,J. Case is called out. None appears for the petitioners. Record shows that the present petition has been filed with the prayer to call for the record of the case and quash the orders dated 20.05.2014 sent by the respondent no.5 and received by the petitioners on 12.10.2017 and the recommendation dated 2.9.2017 recommending the name of other persons as teacher of the institution in place of the petitioners and a further prayer to direct the respondents to include the name of petitioners while taking institution under the grant-in-aid list of the State Government. Learned Standing Counsel for the State submits that the relief as prayed cannot be granted as the services of the petitioners were terminated by the Management of the institution on various grounds. Firstly, the institution is not getting any financial help from the Government or its department. The institution is in completely dilapidated and non-operative condition. He further submits that services of none of the teachers have been approved by the competent educational authority. The case is listed in the category of oldest pending cases in the cause list, for priority hearing. A notice has also been placed on the notice board specifically, mentioning that "old cases up to the year 2022 shall be taken up in the first round itself. In case of non-appearance, matter shall be dismissed as infructuous or otherwise, and in the cases, where the cause of action still survives, the concerned advocates are expected to mark them accordingly in the cause list. Failure to do so, may result in its dismissal as infructuous" but, neither the counsel for the petitioners has appeared nor has the case been marked to indicate that the cause of action still survives. This matter is pending since 2019. It appears that either the petitioners have lost interest in pursuing the matter or it has become infructuous. Accordingly, the petition is dismissed as infructuous. Order Date :- 11.8.2025 Kalp Nath Singh Digitally signed by :- KALP NATH SINGH High Court of Judicature at Allahabad
