This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioner/A4, seeking regular bail, in RSS SC No.24 of 2022 on the file of Special Court in the Cadre of Additional District & Sessions Judge for Trial of Red Sanders Smuggling Cases, Tirupati (Crime No.08 of 2016 of RSASTF Police Station, Tirupati District). 2

A case has been registered against the petitioner/A4 herein and others for the offences punishable under Sections 379 of IPC and Section 20(11)(d)(i)(a) r/w 20(1)(c) iv, x 36(a) r/w 32A, 32B of the AP Forest Act, 1967. 3. The brief facts of the case are that on 29.07.2016 night at about 11.30 hours, on receiving credible information, the SI of police along with staff have found one opposite coming Eicher vehicle on Malandhar Road at Chikamangalur. On observing the police party, said lorry was stopped at the road and two persons ran away from the vehicle, while A1 was caught hold by the police along with the eicher lorry loaded with 190 khair and 8 RS logs. On enquiry, A1 revealed that he and A2 and A3 have committed theft of RS logs and khair wood from Seshachalam forests for illegal sales. Then A1 along with the recovered property was brought to RSASTF police station, Tirupati and handed over to the SHO, seeking necessary action. 4. Heard. Perused the record. 5. Learned counsel for the petitioner submits that the petitioner has been in judicial custody since 01.02.2025. Although the petitioner was previously granted bail in this case,

a Non-Bailable Warrant (NBW) was issued against him by the Special Court in the Cadre of Additional District & Sessions Judge for Trial of Red Sanders Smuggling Cases, Tirupati, due to his failure to appear before the Court. The learned counsel for the petitioner further submits that most of the witnesses are examined and the trial is in prgogress.
The learned counsel for the petitioner further submits that the petitioner was unable to appear before the court due to lack of proper information regarding the Court proceedings. The learned counsel assures that the petitioner will attend all further hearings and will cooperate fully with the Court for the expeditious disposal of the matter. The learned Assistant Public Prosecutor has not opposed the same. 6. Considering the submissions made by both the learned counsels, this Court is inclined to grant bail to the petitioner with the following conditions:
(i) The petitioner/accused shall be released on executing a personal bond for Rs.25,000/- (Rupees twenty five thousand only) with one surety for a like sum each to the satisfaction of the learned V Additional Junior Civil Judge, Tirupati. 4
(ii) After release, the petitioner shall appear before the concerned Court for every adjournment. (iii) Further, the petitioner is directed not to hamper the investigation and tamper with the prosecution witnesses. 7. Accordingly, the Criminal Petition is allowed. _____________________ T.
