The present petition has been filed by the petitioners challenging the order dated 23.10.2024 passed by the learned Controller Authority, Payment of Gratuity Act, 1972/Assistant Labour Commissioner, Lucknow in P.G. Case No. 234/2018, whereby the claim of the petitioner for grant of balanced gratuity along with interest was rejected. Learned counsel for the respondents states that an appeal is prescribed under the Payment of Gratuity Act. Upholding the said objection, present petition is disposed of permitting the petitioners to file an appeal against the impugned order. In case, the appeal is filed within a period of four weeks from today, the same shall not be dismissed on the ground of limitation and shall be heard and disposed of on merits in accordance with law.
