The present petition has been filed challenging an order dated 11.07.2012 passed in P.A. Case No.3 of 2006 as well as the order dated 28.09.2016 passed in Rent Appeal No.33 of 2012, whereby orders were passed against the petitioners under Section 21(1)(a) of the U.P. Act No.13 of 1972. 2. The petitioners claim that a declaratory suit at the instance of the petitioners was filed, as such, no eviction could have been initiated by means of the impugned orders. 3. Be that as it may, if declaratory suit is filed, the same shall be decided on its own merit without being influenced by the abovesaid two orders impugned and in accordance with law. 4.
