Laskar, learned counsel for the petitioners. Also heard Mr. R. J. Baruah, learned Additional Public Prosecutor for the State respondent. This is an application under Section 438 of the Code of Criminal Procedure, 1973 praying for grant of pre-arrest bail to the accused/petitioners, who are apprehending arrest in connection with Borkhola P.S. Case No. 55/2024, under Sections 120(B)/147 /148/447/323/324/325/326/307 of the Indian Penal Code. The case was fixed today for production of Case Diary; however, it is submitted by the learned Additional Public Prosecutor, Mr. Baruah, that the I.O. has already filed Charge-Sheet, vide Charge-Sheet No. 129/2024, dated 30.12.2024, and accordingly submitted that the present anticipatory bail application has become infructuous. In this context, Mr. Laskar, learned counsel for the petitioners, has submitted that after obtaining the order of interim pre-arrest bail, the petitioners have already appeared before the I.O. and their statements under Section 161 Cr.P.C. have already been recorded and hence, he prayed for extending the interim pre-arrest bail till their appearance before the learned Court below. Page No.# 4/4 Considering the submissions made by the learned counsels appearing for both sides and also considering the fact that the I.O. has already filed Charge-Sheet No. 129/2024, dated 30.12.2024, the petitioners are hereby directed to appear before the learned Court below within 15 (fifteen) days from the date of this order with an appropriate application for grant of regular bail, which shall be considered by the learned Court below in accordance with law. Till then, the interim pre-arrest bail granted to the accused/ petitioners, namely, (i) Jalal Uddin @ Jalal Uddin Choudhury, (ii) BIlal Uddin @ Bilal Uddin Choudhury, (iii) Altaf Hussain Choudhury @ Hussain Ahmed Choudhury, (iv) Md. Taibur Rahman Choudhury @ Tayab Uddin Choudhury, (v) Misluk Uddin @ Misluk Uddin Choudhury, (vi) Ajmol Hussain Choudhury, (vii) Miftaul Hussain Choudhury @ Mizazul Hussain Choudhury, (viii) Alkas Uddin @ Aklas Uddin Choudhury, & (ix) Faruk Uddin @ Gias Uddin Choudhury, vide order dated 26.06.2024, shall remain extended.
