Though, notice has not been served upon the opposite party nos. 4 and 5 but in view of the aforesaid order, notice to aforesaid opposite parties are hereby dispensed with. By means of the instant petition, the petitioner has prayed the following relief:- "(I) To Issue a writ order or direction in the nature of Certiorari quashing the impugned select list dated 01.06.2020 issued by the department of respondents no.1 to 3 after summoning the original from them, the portion of the impugned list dated 01.06.2020 is being annexed as Annexure No.1 to this writ petition. (II) To Issue a writ order or direction in nature of Mandamus Commanding and directing to the opposite party no.1 to 3 to issue the fresh list after redrawing the same strictly by following the provisions of section 3 (6) of the act 1994 Rule 9 and Rule 14 of the Rules of 1981 by specifically notifying the marks of A.T.R.E. the quality point marks and the category of the candidates as well as the category of the in which the candidates have been selected, in the interest of Justice" It has been informed at the bar that the controversy in question has been decided by this Court vide judgement and order dated 13.03.2023 passed in bunch of writ petitions bearing leading Writ-A No. 13156 of 2020, Mahendra Pal and Others Vs. State of U.P. and Others. Further, in the aforesaid bunch of matters the special appeal has already been disposed of finally with minor modifications. Thereafter, the matter went in SLP before the Apex Court, where the SLP is pending consideration, therefore, this writ petition may be decided finally in terms of judgement and order in Re:- Mahendra Pal and Others (Supra). Considering the aforesaid submission of the learned counsel for the parties, I hereby dispose of this petition finally in terms of judgement and order dated 13.03.2023 in Re:- Mahendra Pal (Supra). It is needless to say that the final outcome of the SLP pending before the Apex Court would be applicable in the controversy in question.
