Learned counsel for the respondents submits that, in essence, the petition at hand is filed to command the respondents to pass appeal effect order and issue refund in its favour in terms of order dated September 30, 2019 passed by Commissioner of Income Tax (Appeal) J&K, Jammu along with interest.

He submits since the necessary order under Section 250 (6) of the Act has been passed on April 01, 2024 by the competent Authority, as a result Rs. 16,78,444/- are being reimbursed to the petitioner along with interest in terms of the provisions of Section 244-A (b) of the Act. And the requisite amount in this regard shall be credited in the Bank Account of the petitioner within six weeks from today.

As regards the refund adjustment claims of M/s Laxman Dass Om Parkash Bamba, (Rs. 3,44,350/-) as also an amount of Rs. 25,275/- recovered on account of rent from the Director, Local Bodies, the matter shall be examined by the competent Authority. And if necessary, the petitioner shall also be afforded an opportunity of hearing, whereupon formal orders shall also be passed within six weeks.

In the wake of the above, learned counsel for the petitioner submits that, for the present, nothing substantive survives in the petition and the same be disposed of in terms of the statement made by learned counsel for the respondents. However, liberty be granted to move an appropriate application in this petition itself, just in case the order that is being passed is not complied with.
5. The petition is, accordingly, disposed of in the above terms with liberty prayed for.
