Court No. - 1 Case :- CRIMINAL MISC. WRIT PETITION No. - 25544 of 2021 Petitioner :- Ranoo Singh Respondent :- State Of U.P.Thru.Prin.Secy.Home Lucknow And Ors. Counsel for Petitioner :- Ashish Kumar Singh,Ajay Shukla Counsel for Respondent :- G.A.,Shiv P. Shukla Hon'ble Ramesh Sinha,J. Hon'ble Mrs. Renu Agarwal,J. Personal affidavit of Commissioner of Police, Lucknow filed today is taken on record. Heard Shri Jyotindra Mishra, Senior Advocate assisted by Shri Ashish Kumar Singh, learned Counsel for the petitioner, Shri Arunendra, learned Additional Government Advocate for the State- respondents and perused the material brought on record. However, Shri Shiv P. Shukla, learned Counsel for C.B.I. is not present. This writ petition has been filed by the petitioner - Ranoo Singh with a prayer to issue a writ in the nature of mandamus thereby commanding the respondents to transfer and entrust of the investigation of FIR dated 07.01.2021, registered as FIR No.0015 of 2021, under Sections 120-B, 302, 307, 34 I.P.C., Police Station Vibhuti Khand, District Lucknow to Central Bureau of Investigation and further direct the respondent no.5 to carry out a speedy and expeditious investigation in the aforementioned case within a specified time. It has been argued by learned Counsel for the petitioner that the petitioner is informant of the present case. He has lodged the impugned FIR against three accused persons. He further submits that Ex.M.P. -Dhananjay Singh is also involved in the murder of husband of the petitioner and when the local police had collected the cogent evidence against the said Ex.M.P.- Dhananjay Singh, the investigation was transferred to S.T.F. He next submitted that Ex.M.P.- Dhananjay Singh is a hardened criminal and because of his political influence, the investigation of all the cases which have been registered against him, has been transferred to S.T.F. in order
to undermine the criminal cases against him, hence the investigation be transferred to some independent agency in order to unearth the truth. It is submitted that Ex.M.P.- Dhananjay Singh, is a history sheeter having criminal cases of 40 cases including present case as well as cases under Section 302 I.P.C. which have been registered at various police stations at various Districts of the State. Learned A.G.A., on the other hand, has opposed the prayer and submitted that in the present case, charge sheet has been submitted against 13 accused persons.
So far as Ex.M.P.- Dhananjay Singh is concerned, charge sheet has also been submitted against him and in the present case, he has been charge sheeted for the offence under Sections 212, 176 I.P.C. before the competent Court, i.e., Chief Judicial Magistrate, Lucknow on 20.08.2022, which is clear from the copy of letter dated 21.11.2022 of Investigating Officer, S.T.F., U.P. Lucknow, which is annexed as Annexure No.2 to the personal affidavit of Commissioner of Police, Lucknow. After having considered the submissions advanced by learned Counsel for the parties, we do not find any ground to entrust the matter to any other independent agency, such as C.B.I. as in the present case charge sheet has already been submitted against 13 accused including including Ex.M.P. -Dhananjay Singh, whose involvement in the murder of husband of petitioner has been shown during investigation by the S.T.F. The instant petition lacks merit and is accordingly dismissed. In case the petitioner is aggrieved against the said charge sheet for the offences in question against accused - Dhananjay Singh, she is at liberty to take recourse to law. (Mrs. Renu Agarwal, J.)
