The petitioner claims obstruction/ encroachment on a public way, however, when we asked the counsel for the petitioner to demonstrate the said fact, except for showing photographs, which by itself is not sufficient for us to arrive at any such conclusion that it is an obstruction on public way, but without drawing any conclusion in this regard, if the petitioner has moved any application in this regard under Section 152 of the Bhartiya Nagrik Suraksha Sanhita, 2023 before the Sub Divisional Magistrate, Unchahar, District Raebarely, he may look into the matter as to whether the application is maintainable or not, if so, take such action as may be permissible and required under law. 3.
