HIGH COURT OF MEGHALAYA AT SHILLONG MC (CRP) No.23/2025 Date of order: 17.12.2025 Paul Leong ….Applicant - versus - The Archdiocese of Shillong, R/o Laitumkhrah, Shillong, East Khasi Hills District, Meghalaya. ….Respondent Coram: Hon’ble Mr. Soumen Sen, Chief Justice Appearance: For the Applicant : Mr. D. Baruah, Adv with Mr. S.D. Upadhya, Adv For the Respondent : Mr. S. Sen, Adv. with Mr. M.U. Ahmed, Adv. i) Whether approved for Yes/No reporting in Law journals etc.: ii) Whether approved for publication Yes/No in press: JUDGMENT: (Oral) This application has been filed with the caption “an application for extension of sometime due to the filing of SLP(C) bearing Diary No.71348/2025”. 2. The order was passed on 12.11.2025 after hearing the learned counsel for the parties. The application challenging the order of the Execution Court was filed in the year 2024 and the record reveals that on flimsy grounds, prayer for adjournments were made on behalf of the Serial No. 01 Supplementary List 2025:MLHC:1233 applicant. The prayer for adjournment was made either due to the non- availability of the senior counsel or a change of counsel during the proceeding. Umpleen opportunities was given to the applicant to argue the matter. Ultimately on 12.11.2025, the matter was taken up for consideration and disposed of on merits. The decree was passed on 29.11.2012. 3. This application was filed after 19.11.2025 within which time the bailiff was required to carry out certain directions in terms of paragraph 3 of the order dated 12.11.2025. It was only at the stage when a formal possession is required to be given to the decree holder with or without police assistance that this application has been filed on the pretext that a Special Leave Petition was filed on 10.12.2025. Significantly, it was filed after the bailiff had taken steps in this regard. 4. This application is completely unmeritorious and accordingly stands dismissed.
