Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order in Pa.Mu.Pi4/21623/2013 dated 28.05.2019 passed by the second respondent and quash the same. 1/9 https://www.mhc.tn.gov.in/judis W.P(MD)NO.15845 of 2019 For Petitioner : Mr. R.Narayanan For Respondents : Mr.M.Muthumanikkam Government Advocate for R1 & R2 No appearance for R3 Mr.R.Suriya Narayanan for R4 O R D E R An order of the District Revenue Officer is the subject of challenge in this Writ Petition. The petitioner asserts that he has been in uninterrupted possession and enjoyment of the properties mentioned in patta No.2011 at Sirukoodalpatti village, Tirupattur taluk, Sivagangai district. According to the petitioner, the said properties belong to his great grandfather, namely, Ponnachi Konar and that patta passbook number 168 was issued in his name. After the death of the petitioner's great grandfather, it is stated that the properties devolved on the petitioner's grandfather, namely, Mari Konar. The petitioner relies on patta No.635 in the name of Mari Konar. After the demise of Mari Konar, it is stated that the properties devolved on the petitioner, his mother Alagamma and brother Karthik. 2/9 https://www.mhc.tn.gov.in/judis W.P(MD)NO.15845 of 2019 2. In these circumstances, learned counsel for the petitioner states that the District Revenue Officer was not entitled to examine the status of parties and conclude that the names of the third and fourth respondents should be included in joint patta No.2011. Learned counsel further submits that several supporting documents such as the registered gift deed, voters list, voter ID, Solvency Certificate, etc. were submitted and these documents were not duly considered. Therefore, learned counsel submits that the impugned order is liable to be interfered with. 3. Learned Counsel for the respondents 3 and 4 made submissions to the contrary. By referring to and relying upon the impugned order, he submits that all the materials placed on record were considered and that findings were entered on the basis of statements made by the petitioner. In particular, he invited my attention to the operative paragraphs of the impugned order. 4. On perusal of the impugned order, it appears that the District Revenue Officer considered the materials on record and the statements made by the parties before the revenue authorities. Thereafter, the 3/9 https://www.mhc.tn.gov.in/judis W.P(MD)NO.15845 of 2019 following conclusion was recorded: “...... vdNt> vjpu;kDjhuu;fs; %tUk; gl;lh khw;wk; nra;Js;sJ jtwhFk;. kDjhuu;fspd; jfg;gdhu; jpU.fUg;igah Nfhdhu;> nghd;dhr;rpf; Nfhdhupd; kfd;jhd; vd;Wk;> khupf;Nfhdhupd; cld;gpwe;j rNfhjuu;jhd; vd;Wk; xg;Gf;nfhs;Sk; vjpu;kDjhuu;fs;> fUg;igah Nfhdhu; rpWtajpy; NtnwhU egUf;F gps;isahf Ngha;tpl;lhu; vd;W njuptpf;Fk; Neu;tpy;> nghd;dhr;rp Nfhdhupd; nrhj;Jf;fspy; fUg;igah NfhdhUf;F ghj;jpak; cz;lh? ,y;iyah? vd;gjw;fhd njspthd Mjhuq;fs; VJk; rku;g;gpf;ftpy;iy. On examining the above extract, it is evident that disputed questions arise with regard to the entitlement of the rival claimants to the properties. Adjudication of these disputed questions cannot be undertaken in summary proceedings, such as the present Writ Petition. In fact, the impugned order itself records that parties may approach the jurisdictional Civil Court if aggrieved by the order. The Writ Petition was filed in the year 2019 and the petitioner obtained an interim stay of the 6/9 https://www.mhc.tn.gov.in/judis W.P(MD)NO.15845 of 2019 impugned order which remains in force as on date. 6. Considering these aspects, it is just and necessary that such interim order continues to operate until disposal of the civil suit wherein the rights of parties may be duly adjudicated after trial. Because the petitioner approached this Court bona fide and prosecuted this petition with due diligence, it is also necessary to exclude the time taken in prosecuting this Writ Petition for purposes of computing limitation for filing the civil suit. Therefore, such period shall be excluded and the petitioner and the third and fourth respondents are granted leave to file a civil suit before the jurisdictional civil court. 7. This Writ Petition stands disposed of on these terms. No costs. Consequently, connected miscellaneous petitions are closed. NCS : Yes/No 11.09.2025 Index : Yes / No Internet : Yes / No apd To 1.
