Ms. Prabha Naithani, Advocate, for the petitioner.
Mr. N.K. Papnai, Standing Counsel, for the State. (2) By means of this writ petition, petitioner has sought the following relief:
“(i) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents to forthwith issue appointment to the petitioner on the post of Aganbari Karyakarti, Aganbari Center Lakhamandal, district Dehradun pursuant to merit/selection list dated 08.05.2025 (Annexure-6)”
(3) Learned State Counsel, however, submits that the caste certificate issued to the petitioner, wherein she was declared as a person belonging to Scheduled Tribe, has been cancelled on a complaint. He further points out that petitioner has challenged the cancellation order by filing Writ Petition (M/S) No. 1075 of 2018. He thus submits that till the time the writ petition is decided in favour of petitioner and the caste certificate is restored back to the petitioner, she cannot be given any benefit of ST candidate.

Learned Counsel for the petitioner, per contra, submits that as per her score of marks, petitioner is entitled for appointment against a vacancy reserved for ST candidate; a coordinate Bench in Writ Petition (M/S) No. 1075 of 2018 has stayed the cancellation order, therefore there is no reason or justification whatsoever for not
2025:UHC:10060 offering appointment to the petitioner on the post Aanganbari Karyakarti.
(5) This Court is not inclined to go into the issues raised by the petitioner in this writ petition, as the validity of cancellation order is to be tested in a separate writ petition pending before coordinate Bench of this Court. However, having regard to the facts of the case, writ petition is disposed of with liberty to the petitioner to make a representation to the competent authority. If she makes representation within one week from today, decision thereupon shall be taken by the competent authority within four weeks thereafter.
