31. 10.03.2025 Court No.26 (DO) (Pritam) IN THE HIGH COURT AT CALCUTTA CRIMINAL MISCELLANEOUS JURISDICTION CRM (DB) 711 of 2024 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure, 1973 / Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, arising out of Burtolla Police Station Case No.434/2013 dated 01.09.2013 under Sections 120B/366B/370(4)/370(A)/373 of the IPC, 1860 & Sections 17/21 of the POCSO Act & Sections 4/5/6 of the Immoral Traffic (Prevention) Act, 1956 & Sections 14B & 14C of the Foreigners Act. And In the matter of: - Biswanath Dhibar @ Bishu Dhibar @ Bishu Dhabar. ..…petitioner. Mr. Soumyajit Das Mahapatra, Mr. Abdul Aziz Mondal ...for the petitioner. Mr. Rudradipta Nandy, Ld. A.P.P., Ms. Arani Bhattacharyas ...for the State. 1. Report submitted on behalf of the State be taken on record. 2. Co-ordinate bench by an order dated March 5, 2024 rejected the prayer for bail of the petitioner, inter alia, on the ground of high possibility of absconsion. 3. Co-ordinate bench, however, required the trial court to take all necessary steps for examination of the remaining prosecution witnesses and conclude the trial preferably within six months from the receipt of the trial court records. 2 4. Report speaks of only 2 prosecution witnesses remain to be examined, i.e., the two Investigating Officers. Report also speaks of the next date being fixed on March 17, 2025 by the learned Trial Court for the purpose of recording of the evidence of the first Investigating Officer. 5. In such circumstances, we dispose of CRM (DB) 711 of 2024 by requesting the trial court judge to dispose of the trial as expeditiously as possible. (Debangsu Basak, J.) (Md. Shabbar Rashidi, J.)
