[2025:RJ-JP:17475] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 5132/2025 Ummed Singh Shekhawat S/o Narayan Singh Shekhawat, R/o Balaji Ke Mandir Ke Pass, Gram Anantpura, Manda, Bheem Singh, Jaipur. ----Petitioner Versus 1. State Of Rajasthan, Through The Secretary, Transport Department, Government Of Rajasthan, Jaipur. 2. Assistant Regional Traffic Office (ARTO), RTO Department, Jagatpura, Jaipur, Rajasthan. ----Respondents For Petitioner(s) : Mr. Sahaj Veer Baweja with Mr. Anuj Jain HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 24/04/2025 Instant writ petition has been preferred by the petitioner being aggrieved of the action taken by respondents against the petitioner’s vehicle which is his source of livelihood. It is submitted that when petitioner tried to renew the documents of his vehicle, he was unable to do it thereafter, he checked status of his vehicle on the official website M-Parivahan Portal of the department and he found that his vehicle has been locked by respondent No.2 and a note has been mentioned on his vehicle status showing “Locked by JAGATPURA, JAIPUR ARTO, Rajasthan due to reason Others, SOG INVESTIGATION JAGATPURA dated 25-Oct-2024”. It is submitted that before taking this action, neither notice was served upon the petitioner nor any opportunity of hearing was granted to [2025:RJ-JP:17475] (2 of 2) [CW-5132/2025] him. Learned counsel contends that a representation was also submitted by the petitioner on 03.02.2025 against the action of respondents but till date, no decision has been taken on the representation submitted by the petitioner. It is contended that Motor Vehicles Act does not have a specific provision for displaying or recording a vehicle's status as "locked". In view of above facts and circumstances of the case, particularly representation of the petitioner submitted before the respondents, I deem it just and proper to dispose of this writ petition with direction to the petitioner to approach respondents by filing an appropriate application for deciding the representation submitted on 03.02.2025. If any such application is filed by petitioner along with certified copy of this order within a period of two weeks from today, respondent authority is directed to pass a speaking order on the application within a period of four weeks from the date of submission of the said application in accordance with law. With the aforesaid directions, this writ petition stands disposed of. Stay application as well as pending application(s), if any, also stand disposed of. (ANIL KUMAR UPMAN),J CHARU SONI /58
