The present petition has been filed for quashing of FIR No. 172 of 2023, dated 08.11.2023, registered for the commission of offences punishable under Sections 147, 149, 323 and 325 of Indian Penal Code (IPC) at Police Station Majra, Tehsil Paonta, Sahib, District Sirmour, H.P. . and consequent proceedings arising out of the said F.I.R based on compromise effected between the parties. 2 2025:HHC:25015
2. It has been asserted that the parties have entered into a compromise with the intervention of the respectable members of the society. The informant does not want to proceed further with the matter in view of the compromise. Hence, the present petition. 3. Statement of informant was recorded on 17.06.2025, in which he stated that the matter had been compromised between the parties voluntarily without any influence from any person and they he has no objection, in case the FIR lodged against the petitioners/accused is ordered to be quashed. 4. The offences punishable under Sections 323 and 325 of IPC are compoundable under Section 320 of Cr.P.C. Section 320 (3) of Cr.P.C. provides that when an offence is compoundable under Section 320 of Cr.P.C. the abatement or attempt to commit the offence or when the accused is liable under Section 34 or 149 of IPC may be compounded in the like manner. The offence punishable under Section 149 of IPC can be compounded as per Section 320(3) of Cr.P.C. This Court had already quashed the F.I.R. registered for the commission of offences punishable under Section 147 of IPC in Umesh Kumar vs State Kumar HP 2022 STPL 10721, Satish Kumar State of H.P. 2022 STPL 10703, Inderjeet vs State of H.P. 2022(2) Himachal Law Reporter 1217 and Subhash Verma vs State of H.P. 2021 (3) Shimla Law Cases 1146. 3 2025:HHC:25015

Consequently, the present petition is allowed and FIR No.172 of 2023, dated 08.11.2023, registered for the commission of offences punishable under Sections 147, 149, 323 and 325 of IPC at Police Station Majra, District Sirmour, H.P. is quashed and the consequent proceedings pending/initiated against the petitioners- accused in pursuance thereto are also quashed. 6. Petition stands disposed of in the above terms, so also pending miscellaneous applications, if any. 7. Parties are permitted to produce a copy of this judgment, downloaded from the webpage of the High Court of Himachal Pradesh before the authorities concerned, and the said authorities shall not insist on the production of a certified copy but if required, may verify passing of the order from Website of the High Court.
