BEFORE HON'BLE MR. JUSTICE ROBIN PHUKAN ORDER 19.06.2025 Heard Mr. W. Hoque, learned counsel for the applicants and also heard Mr. H. Buragohain, learned counsel for the opposite parties/respondents. This application under Order 22 Rule 9 of the Code of Civil Procedure, 1908 is preferred by the applicants for setting aside abatement in respect of deceased petitioner No.4, namely, Surinder Singh Gulati in CRP No.295/2014. Mr. Hoque, learned counsel for the applicants submits that the petitioner No.4, namely, Surinder Singh Gulati suffered demise on 16.03.2021, and his legal heirs have already been impleaded in CRP No.295/2014 and as such, there is a requirement for setting aside abatement against the petitioner No.4 in CRP No.295/2014. Mr. Buragohain, learned counsel for the opposite parties submits that he has no objection.
Taking note of the submission of learned counsel for both the parties and also considering the facts and circumstances on the record, this Court is inclined to set aside the abatement as against the petitioner No.4 in CRP No.295/2014. In terms of above, the I.A. stands disposed of. The learned counsel for the applicants shall file amended cause title in CRP No.295/2014 within a period of week from today and thereafter, Registry shall list the connected CRP on 12.08.2025.
