This petition under Section 483 Cr.P.C. now Section 529 B.N.S.S, 2023 has been filed for a direction to frame the charges in Case No. 80697 of 2022, arising out of Case Crime No. 0363 of 2021, under Sections 323, 504, 506, 420, 406, 467, 468, 471 of I.P.C., Police Station-Vibhuti Khand, District- Lucknow, pending in the Court of A.C.J.M., Lucknow, without giving unnecessary adjournments to the parties and proceed in compliance of Section 346 of B.N.S.S., 2023. 3. In view of above as also the law laid down by the Hon'ble Apex Court, present petition is disposed of with liberty to the applicant to move an appropriate application before the Court concerned and in case, such an application is moved by the applicant, then, the same shall be considered by the Court concerned keeping in view the provisions of Section 346 of B.N.S.S., 2023 expeditiously and shall proceed accordingly.
