No. - 624 of 2025 Applicant :- Udaybhan Verma Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Deppt. Lko. U.P. And Another Counsel for Applicant :- Balak Ram Counsel for Opposite Party :- G.A. Hon'ble Subhash Vidyarthi,J.
1. Heard Sri Balak Ram Verma, learned counsel for the applicant, Ms. Shikha Sinha, learned AGA for the State and perused the records.
2. The instant application has been filed by the applicant seeking anticipatory bail in Case Crime No. 94/2011, under Sections 272, 273 & 418 IPC, Police Station Sammanpur, District Ambedkar Nagar.
3. The aforesaid case has been registered on the basis of an FIR lodged on 16.02.2011 stating that samples of mustered oil were drawn from the applicant's provision store and upon testing of the same by the Public Analyst, U.P., Lucknow, it came to light that the mustered oil being sold by the applicant was adulterated.
4. Having considered the facts that the applicant, prima facie, appears to be guilty of selling adulterated food oil, I am of the view that the aforesaid does not entitle the applicant to invoke the discretion of this Court by granting him pre-arrest bail.
5. The anticipatory bail application is rejected accordingly.
6. However, in case the applicant files an application for grant of bail, the same shall be considered and decided on its merits, without being influenced by any observations made in this
order.
