JUSTICE SINDHU SHARMA, JUDGE ORDER 20.12.2025 1. Petitioner claims to be a political and social worker, who has to travel in the Union Territory of Jammu & Kashmir to meet the people. The petitioner submits that at present, he is the State Secretary of All India Forward Block, a political party of national level, beside he is General Secretary of All India Social Justice and Human Right Affair and also has been Chairman of All India Trade Union Congress. 2. The contention of the petitioner is that he was having threat perceptions since early 1990 from the militant organization and there was also attack at the house of the petitioner which had resulted in bullet injury to his mother, who died, as a result of this incident. The petitioner submits that in view of the threat perceptions to the petitioner, the respondents had provided security to the petitioner from time to time in 2007. 3. The stand taken by the petitioner is that he has contested the Lok Sabha Election 2024 from Jammu-Reasi Parliamentary Constituency under the Symbol of Indian National Forward Block. 2 During campaigning, he had suffered threat perceptions and the respondents had deputed three security personnel of Indo Tibat Border Police (ITBP) and three from District Police Line (DPL). The petitioner had to travel all over Union Territory including Anantnag and Srinagar, as such, requires protection from the respondents so that he can freely meet the people. 4. The grievance of the petitioner is that members of squad deputed for security cover of the petitioner informed him that they are deputed till 04.06.2024 and thereafter they have to report back to their respective offices, without any notice to the petitioner, though he has reasons to believe that he is in the category of people, who requires security cover, thus, he prays for direction to the respondents to continue to provide security cover to the petitioner and not to withdraw the security cover which has been provided to him. 5. Notice was issued in this petition on 05.06.2024 and thereafter the petition is pending before this Court. Objections have also not been filed by the respondents. 6. It is also well settled that the threat perceptions to an individual is to be considered by the Security Agencies of the State/Union Territory, for which, a Review Committee has been established by the respondents. 7. Mr. Saksham Singh Bhau, learned counsel for the petitioner, submits that the petitioner would be satisfied if this petition is disposed of by directing the respondents to consider the claim of the petitioner for providing security cover to the petitioner as has been provided him, in accordance with law. 3 8. Mrs. Monika Kohli, learned Sr. AAG submits that the request of the petitioner would be considered in accordance with law if he approaches the respondents for the same. 9. Having regard to the aforesaid facts and submissions and with the consent of the learned counsel for the parties, this petition is disposed of with direction to the respondents to consider the threat perceptions to the petitioner and pass a speaking order in this regard, within a period of eight weeks, from the date copy of this order is made available to the respondents by the petitioner.
