THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner has sought for the following reliefs:- “WHEREFORE, it is respectfully prayed that this Hon'ble Court may be pleased to quash the entire proceedings in CC No.75531/2024 for the offences punishable U/Sec. 115(2), 118(1), 126(2) & 351(2) BNS 2023, pending on the file of XXIX ACJM Court, Bangalore, in the interest of justice." 2. Learned counsel for the petitioner/accused No.1 and learned counsel for respondent No.2/complainant have filed a compromise petition duly signed by the petitioner, 2nd respondent and their respective counsel and the same is taken on record. 3. Petitioner/accused No.1 and his counsel and counsel for respondent No.2 are physically present before the Court and they admit the contents of the compromise petition which reads as under:- - 3 - HC-KAR NC: 2025:KHC:20799 CRL.P No. 877 of 2025 “Compromise petition under Section 528 of Bharathiya Nyaya Sanhita-2023 The petitioner and respondent No.2 most respectfully submit as under: 1. That the petitioner is the accused in the above- mentioned case, wherein proceedings have been initiated under section 115(2), 118(1), 126(2) and 351(2) of the Bharathiya Nyaya Sanhita-2023 pending before the Hon'ble XXIX Additional C.J.M Bengaluru in CC.No.75531/2024. 2. That the respondent / complainant has lodge a complaint against the petitioner before the first respondent Kothanur police on 18/08/2024, the respondent No.1 has registered case in Crime No.360/2024 against the petitioner. 3. That the petitioner has filed this present petition sought for quashing proceedings against the petitioner. 4. That, during the pendency of the proceedings, at the intervention of the elders and well- wishers, both the parties have amicably settled the matter out of Court. There are no outstanding claims or grievance between that the parties. 5. That both parties have agreed to compromise the matter voluntarily, without any coercion, undue indulgence, or monetary inducement. - 4 - HC-KAR NC: 2025:KHC:20799 CRL.P No. 877 of 2025 6. That in light of the compromise, the complainant does not wish to pursue the complaint and has no objection to the quashing of the proceedings pending before the Hon'ble XXIX. Addl. C.J.M Bengaluru in CC.No. 75531/2024. 7. That the offences under the abovementioned sections are compoundable in law as per the provisions of the Bhartiya Nyaya Samhita, 2023. 8. That it is in the interest of justice that the Hon'ble Court may be pleased to accept the compromise and quash the proceeding in the above matter. WHEREFORE. The parties respectfully pray that this Hon'ble court may kindly be pleased to; a) Accept the compromise entered in to between the petitioner and the respondent. b) Quash the criminal proceedings in CC.No.75531/2024 on the file of XXIX Addl. C.J.M Bengaluru under sections 115(2), 118(1), 126(2) and 351(2) of the Bharathiya Nyaya Sanhita-2023. c) Pass such other orders as this Hon'ble Court may deem fit in the interest of justice and equity." - 5 - HC-KAR NC: 2025:KHC:20799 CRL.P No. 877 of 2025 4. In view of the aforesaid settlement entered into between the petitioner/accused No.1 and 2nd respondent, I pass the following: ORDER (i) The petition is disposed of in terms of compromise petition dated 16.06.2025. (ii) The proceedings in C.C.No.75531/2024 (arising out of Crime No.360/2024 of 1st respondent – Police registered for the offences punishable under Sections 115(2), 118(1), 126(2), 351(2) of Bharatiya Nyaya Sanhita, (BNS), 2023 pending on the file of the XXIX ACJM Court, Bengaluru, insofar as the petitioner/accused No.1 is concerned are hereby quashed.
