This petition has been filed by the petitioners only on account of the fact that the Waqf Tribunal is not functional due to absence of quorum. However, we find that there has been a recent amendment to Section 83 of the Waqf Act namely, the Unified Waqf Management, Empowerment, Efficiency and Development (UMEED) Act, 2025, wherein a proviso has been added to the effect that if there is no Tribunal or the Tribunal is not functioning, any aggrieved person may appeal to the High Court directly. Therefore, a writ petition does not lie, at best, an appeal may lie. 2. The petition is disposed of accordingly, with the aforesaid liberty to file an appeal.
