During the course of arguments, learned counsel for the petitioner admitted that proceedings under Section 67 of the U.P. Revenue Code have been initiated against the petitioner. He seeks the benefit of Section 67-A on the ground that he had a house built on the land in question prior to the cut-off date mentioned in the said provision. 2. If it is so, the petitioner can take this as a defence in the proceedings under Section 67 or move a separate application, if otherwise permissible, before the Sub Divisional Magistrate concerned for the determination of his rights. In either eventuality, the plea of the petitioner would be considered and a decision shall be taken thereon after getting the facts verified in accordance with law. 3.
