Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioners submits that the petitioners were arraigned as A.3 and A.13 in Crime No.70 of 2025 of Dargamitta Police Station, SPSR Nellore District, registered for the offence under Sections 316(4), 316(5), 351(3) of the Bharatiya Nyaya Sanhita, 2023, on the complaint of the 2nd respondent. 3. The learned counsel further submits that the petitioners are the panel advocates of the Bank, providing legal advice upon the request of the Bank. However, the 2nd respondent filed a complaint against the petitioners and other accused, despite the petitioners having no involvement in the alleged cheating offence. It is further submitted that the petitioners’ role was limited to providing legal opinions as required by established procedures for loan disbursement, and they have not committed any offence, much less the alleged offence. 4. Considering the same, the Station House Officer, Dargamitta Police Station, SPSR Nellore District, to complete the investigation in Crime No.70 of 2025 by following the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, without taking coercive steps against the petitioners, including arrest. This 3 order would not preclude the investigation officer from filing charge sheet or final report upon completion of the investigation. 5. Accordingly, the criminal petition is disposed of. 6.
