D.No. 4-143/3, SC Peta, Mirthipadu Village, Sithanagaram Mandal, East Godavari District Petitioner/Accused No.9 AND The State of Andhra Pradesh, Through Station House Officer, Seethanagaram P.S, Rajamahendravararn, Represented by Public Prosecutor, High court of A.P Respondent Petition under Section 482 of BNSS is filed is filed praying that in the circumstances stated in the affidavit filed in support of the Criminal Petition, the High Court may be pleased to enlarge them on anticipatory bail in the event of their arrest in connection with the crime no.31 of 2025 of Seethanagaram PS subject to any condition as may be imposed by this Hon’ble Court as it seems fit and necessary. lA NO: 1 OF 2025 praying that in the under Section 528 of BNSS is filed Petition circumstances stated in the affidavit fiied in support of the petition, the High Court may be pleased to direct the Station House Officer, Seethanagaram Police Station to not to take any coercive steps against the petitioner/ Accused ^ pending the disposal of the criminal petition in the interest of justice. no.9 for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of SUBASH Advocate for the Petitioner, The petition/Appeal coming on PUBLIC Sri DUGGIRALA PROSECUTOR (AP) for the Respondent and the Court made the following. The Court made the following Order: This Criminal Petition has been filed by the petitioner/A9, seeking anticipatory bail, in connection with Crime No.31 of 2025 of Seethanagaram Police Station, East Godavari District. A case has been registered against the petitioner herein and others for the offence punishable under Sections 118(1), 109(1), 189(2) and 189(4) read with 190 of the BNS. Case of the prosecution, in brief, is that, on 03.02.2025 at about 08.30 a.m, the de-facto complainant lodged a report stating that his villagers Guru Siva Sathish, Kalla Nagendra, and Kalla Durga Prasad were present at Mirthipadu Pathapeta Center. At that time, one Vadapalli Suresh S/o Jayaraju and Bannu, who belong to SC community, picked up argument with them. The de-

After some time, while he was present at his house, A1 to A14 along with others came to him and beat him with sticks on his head and caused bleeding and abrasion injuries. Immediately, the de-facto complainant shifted to Hospital for treatment. \ \
4. Heard. Perused the record.
Learned counsel for the petitioner submits that similarly
5. placed persons i.e. A5, A7, A10, A13 and A14 have obtained anticipatory bail from a Co-ordinate Bench of this Court in the very vide
order in Crl.P.No.2393 of 2025, dated same crime
27.03.2025.
6. On the other hand, learned Assistant Public Prosecutor has not disputed the submissions made by the learned counsel for the petitioner. As seen from the order dated 27.03.2025 in Crl.P.No.2393
7. of 2025, this Court observed that,
“it is specifically alleged that A1 beat the defacto complainant with a stick on his head resulting in grievous injury to him. However, with respect to the other accused. only omnibus allegations are made.” In the said facts of the case there are no specific accusations have been made against the petitioner herein. V
3 Considering the above factors, since the case of the present petitioner is also on the same footing as that of A5, A7, A10, A13 and A14 who were already granted anticipatory bail by this Court, this Court is inclined to grant anticipatory bail to the petitioner herein/A9, on the following conditions. Accordingly, in the event of his arrest, the petitioner herein shall be released on bail on executing a personal bond for a sum of Rs. 10,000/- (Rupees ten thousand only) with two sureties for the like sum each to the satisfaction of the arresting police officials and also on condition that the petitioner shall make himself available for investigation as and when required and that he shall not cause any threat, inducement or promise to the prosecution witnesses. The petitioner herein shall appear before the Station House Officer concerned, once in a week i.e. on every Sunday between 10.00 a.m. and 05.00 p.m., till filing of the charge sheet. Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending, shall stand closed.
