The instant writ petition has been filed praying for following main reliefs: "issue a writ, order or direction in the nature of certiorari to quash the impugned Judgment and order dated 12.08.2021 1 passed by the Special Judge, SC/ST Act/Additional Session Judge, Court Room No.2, Gonda in Criminal Revision No.69/2020; Parikrama Jeet Singh and another Versus State of U.P. & other as well as order dated 25.02.2020 passed by Chief Judicial Magistrate, Gonda in Criminal Misc. Case No.4093/2015; State Versus Parikrama Jeet Singh and other, respectively contained in Annexure No.1 & 2 to the writ petition." Earlier, the petitioners approached this Court by means of Application/Petition U/s 482/378/407 No. 1812 of 2016 (Parikrama Jeet Singh And Anr. Vs. State of U.p. and Anr.). By the aforesaid application/petition, the petitioner challenged the charge sheet dated 05.08.2015 in Case Crime No. 451 of 2015, under Sections 147, 323, 504, 506, 452 and 294 I.P.C., P.S. Nawabganj, District Gonda as well as proceedings of Case No. 4093 of 2015 (State Vs. Parikrama Jeet Singh & Ors) pending before the Chief Judicial Magistrate, Gonda. The aforesaid application was disposed by this Court, vide order dated 14.05.2019, after observing that "Considering the arguments advanced by learned counsel for the parties and after going through the contents available on record, prima facie, no case for interference is made out." Above quoted order further indicates that learned counsel for the applicants sought permission to prefer an application seeking discharge. In terms of the aforesaid, the petitioners preferred the application for discharge before the Magistrate. The Magistrate, vide, impugned order dated 25.02.2020, rejected the application. The relevant portion of the same reads as under :- पततवलल कक अवललकन सक सपष हलतत हह कक वतकदनल ममकदमत कवजय शशकर कमशत दतरत पसतमत पतररनत पत अनतररत धतरत-156 (3) दश०प०सश० पर नयतयतलय दतरत पतररत आदकश कक अनमपतलन मम रतनत नवतबरशज मम दजर कक रई। कववकचनलपरतनत कववकचक दतरत अकभयमकरण पररकमतजलत ससशह व ककशल ककशलर कक कवरद आरलप पत अनतररत धतरत-323,504,506, भत०दश०सश० मम कवचतरण हकतम नयतयतलय कदनतशक-18.11.15 कल पककषत ककयत रयत। अकभयमकरण पररकमतजलत ससशह व ककशल ककशलर दतरत अभल तक नयतयतलय मम उपससरत हलकर उक पकरण मम जमतनत नहह करतयत रयत हह। उनमलचन पतररनत पत मम अकभयमकरण पररकमतजलत ससशह व ककशल ककशलर दतरत सजन तथयय कत उलकख ककयत रयत हह उनकक सतयतत कक समबनध मम सतकय कक उपरतनत हल कलई कनषकषर कदयत जत सकतत हह। अभल इस सतर पर मतत कववकचक दतरत सशकसलत सतकय कत हल ममलयतशकन ककयत जतनत हह। कववकचक दतरत सकसलत सतकय सक अकभयमकरण पररकमतजलत ससशह व ककशल ककशलर कक कवरद धतरत-323,504,506, भत०द०सश० कत अपरतध हलनत पतयत रयत हह। इस सतर पर अकभयमकरण कल उनमलकचत ककयक जतनक कत आधतर पयतरप नहह हह। अतएव अकभयमकरण दतरत पसतमत उनमलचन पतररनत पत सवलकतर ककयक जतनक यलगय नहह हह। तदनमरप कनरसत ककयक जतनक यलगय हह। आदकश आवकदक / अकभयमकरण पररकमतजलत ससशह व ककशल ककशलर दतरत पसतमत उनमलचन पतररनत पत कदनतशककत 10.06.19 कनरसत ककयत जततत हह । पततवलल वतसतक हतसजरल अकभयमकरण कदनतशक-22.04.2020 कल पकश हल। अकभयमकरण पमवर आदकशतनमसतर तलब हल। The order of the Magistrate dated 25.02.2020 was assailed by means of Criminal Revision No. 69/2020 (Parikrama Jeet Singh And Anr. Vs. State of U.P. and Ors.) before the revisional Court. The revisional Court dismissed the revision vide, impugned order dated 12.08.2021. The relevant portion of the same reads as under :- अवर नयतयतलय कक समक कवचतरतधलन आपरतसधक वतद मम अकभयमकरण/ कनररतनलकततररण कक कवरद धतरत-323,504,506 भत०दश०सश० मम आरलप पत पककषत ककयत रयत हह। वतदल दतरत अपनक धतरत-161 दश०प०सश० कक बयतन मम कदनतशक- 25.4.2015 कल छपपर कक ररपकररशर करतक समय अकभयमकरण दतरत रतलल रमपत दकतक हहयक मजदमरल कल भरत दकनक और कवरलध करनक पर वतदल कल लतत ममकत सक मतरतक हह पतनल कवमलकश व पमकतयतश कतमनत व सतधनत तरत घर कक पतस कक पररमकशवरल यतदव, सजतकनद, जलरल यतदव आकद कक बचतनक आनक पर ममसलजमतन दतरत जतन सक भतरनक कक धमकक दकतक हहयक चलक जतनक कत अकभकरन ककयत हह। मककक पर आयक सतकलरण कवमलकश, कतमनत, सतधनत, परमकशवरल यतदव, सजतकनद व जलरल यतदव नक घटनत कत समररन ककयत हह। आरलप कक सतर पर अवर नयतयतलय कल मतत यह दकखनत रत कक कयत अकभयमकरण कक कवरद आरलप कवरकचत करनक कत परम दषयत मतमलत बनतत हह। पततवलल पर उपलबध सतकय कक आधतर पर अवर नयतयतलय दतरत अकभयमकरण कक कवरद धतरत- 23,504,506 भत०दश०सश० कत मतमलत पततक हहयक अकभयमकरण कत उनमलचन पतररनत पत अपनक आललचय आदकश कदनतशककत- 25.2.2020 दतरत कनरसत कर कदयत रयत हह। अवर नयतयतलय दतरत अकभयमकरण कक नयतयतलय मम उपससरत हलकर जमतनत न करतयक जतनक कत उलकख मतत ककयत हह, लकककन इस आधतर पर कनररतनलकततररण कक पतररनत पत कत कनसततरण नहह ककयत हह। अवर नयतयतलय कत यह कनषकषर कक अकभयमकरण दतरत सजन तथयय कत उलकख सवयश तरत वतदल कक मधय अनय वतदय कक लसमबत हलनक कक समबनध मम ककयत रयत हह, उनकक समबनध मम कनषकषर सतकय कक उपरतनत हल कदयत जत सकतत हह, उकचत हह। अवर नयतयतलय दतरत कनकहत ककततसधकतर कत पयलर करतक हहयक उभय पक कल समनकर कवसध सममत आदकश पतररत ककयत रयत हह। सजसमम ककसल पकतर कक तथय एवश कवसध कक तमकट - पररलककत नहह हलतल हह। तदतनमसतर कनररतनल कनरसत हलनक यलगय हह। Upon due consideration of the material available on record including the impugned orders, this Court finds no force in the present petition. It is for the following reasons :- (i) Before and during investigation, the ifnormant categorically stated that while he was repariing hatches, the accused (present petitioners) hurled abuses and also assaulted him with kicks and fists as also his wife Vimlesh and daughters namely Kamna and Sadhna. (ii) The independent witnesses also supported the story of prosecutin. Accordingly, the petition is dismissed. Interim order, if any, stands vacated.
