Sri Pawan Kumar Pandey, learned counsel for the petitioner after arguing at some length submits that he does not want to press the instant writ petition and prays that the same may be dismissed as withdrawn with liberty to challenge the seniority list for the year 2015-2016. The same is opposed by Sri Sharad Pathak, learned counsel for the respondent no. 7 by contending that any liberty being granted by this Court for challenging of the seniority list of the year 2015-2016 may explain the laches on the part of the petitioner in not challenging the said seniority list for a period of almost nine years. Needless to mention that any liberty that may be granted to the petitioner can always be in accordance with law and not otherwise. Accordingly, the writ petition is dismissed as withdrawn with the aforesaid liberty.
